After you’re the victim of another party’s negligence in a car accident, make sure that you obtain all identifying information, including insurance information, from the other party. If possible, get identifying information from any witnesses, so that you may be able to call on them in the future to testify to what happened. In the state of Illinois, when the other party is at fault for an accident, you can either report the claim for your damages to your own insurer (a “first party” claim) or to the at-fault party’s insurer (a “third party” claim). There are consequences to each kind of claim, so deciding which type of claim to file may be a question best answered by a legal professional.
You may not feel that you need to hire an attorney to handle your claims, and that you may instead rely on the insurance company to take care of your needs. However, it is worth remembering that every insurance company is interested in paying out as little as possible for each claim submitted. Having a lawyer deal with the insurance company who knows the law, who can conduct an independent investigation into the events surrounding the crash, and who will aggressively represent your interests to ensure you’re fully compensated for any damages or injuries, can make a big difference in your eventual recovery. Additionally, if it becomes apparent that you’ll need to file a lawsuit to recover all compensation you’re owed, it will help you get compensation sooner if you have an attorney who has been with you from the beginning of the claim process.
